Privacy Policy


Pursuant to Articles 13 and 14 of EU Regulation 679/2016 (hereinafter, Regulation) and Legislative Decree 196/2003 as amended, the Data Controller of your personal data Jakala S.p.A. Societ; Benefit with registered office in Corso di Porta Romana n.15,20122 Milan, hereafter also Jakala informs you that the personal data that you will provide or that you have provided to us on the Platform "You@JAKALA" (hereafter Platform) will be processed according to principles of correctness, lawfulness and transparency, respecting your confidentiality and the regulations in force by putting in place the processing necessary to achieve the purposes referred to in paragraph 2 below.

1. Personal data processed

The personal data processed include:

  • Your identifying data (e.g., first name, last name, e-mail address) and additional data that you have made available to Jakala by completing questionnaires on the Platform (e.g., information about your professional background, interests, habits, family composition) and any other personal data obtained by Jakala through the Platform;

It should be noted that the Platform may access some data communicated by the third-party service used for registration or identification, this allows the Platform to identify you and allow you access.

2. Purpose and legal basis for processing

The processing of your personal data is necessary in order to enable us to have a complete overview of the skills possessed by a very large company population present in different geographical areas in order to optimize the activities and services to understand the needs and interests of the employees in order to improve their well-being in the work environment from a person-centric perspective and so in particular:

  • a) Through the completion of questionnaires in the section Your academic and professional background related to your professional background (e.g., training, skills, certifications obtained, etc.), to analyze quickly, efficiently and effectively, the skills possessed (with a view to assignment to projects or job rotation), as well as to allow Jakala to keep in its database, curricula always updated for sending, where necessary, to any customers who may require it in accordance with the principle of minimization (e.g., tenders, specific projects in which special skills are required). The legal basis for the processing is based on the execution of the contract to which you are a party;
  • b) Through the completion of questionnaires in the Tell Us About Yourself section of the Platform, to enable us to improve internal business processes (e.g., welfare plan), consolidate relationships with and among employees (in order to structure e.g., engagement and retention plans with the aim of reducing turnover of the employees) including through the identification of common interests, and enable us to comply with applicable regulations such as e.g., mobility management regulations. The legal basis for processing is based on your free and optional consent;
  • c) Through the completion of questionnaires in the Tell Us About Yourself section of the Platform, to enable us to send you communications consistent with your profile, needs and consumption habits (e.g., communications regarding the presence of new products that may be of interest to you). The legal basis for the processing is based on your free and optional consent;
  • d) to enable you to interact with the Platform (fill out questionnaires, view CV and information entered). The legal basis for processing is based on the performance of the contract to which you are a party;
  • e) To allow us to send you recurring requests for completion, modification or update. The legal basis for processing is based on the performance of the contract to which you are a party;

3. Processing methods

Your personal data will be processed by manual, computer and automated systems for as long as necessary to achieve the purposes for which they are collected or for the period required by law and applicable regulations.

In particular, it is specified that such data will not be disseminated and will be subject to processing by persons identified and/or appointed, appropriately instructed and made aware of the constraints imposed by law, and will be processed by using security measures designed to ensure the protection of your confidentiality and to avoid the risks of loss or destruction, unauthorized access, unauthorized processing or processing that does not comply with the above purposes.

4. Mandatory or optional nature of the processing

The processing of your personal data carried out by the Company for the purposes in points a), d; e) is lawful in that:

  • a) Necessary for the execution of the employment contract;
  • b) Necessary to fulfill legal obligations to which the data controller is subject;

Therefore, any refusal to provide such data will make it impossible for the Company to carry out the aforementioned activities.

The provision of the data necessary for the pursuit of the purposes referred to in points b);c) is optional. It should be noted that any refusal will in no way affect the conduct and continuation of the employment relationship.

5. Recipients of personal data

Your personal data will not be disseminated.

Your personal data may be disclosed to third parties in fulfillment of legal obligations or in order to execute the contractual relationship.

6. Data Protection Officer (DPO)

Pursuant to the art. 37 of GDPR, Jakala has appointed a DPO, identified as Emanuela Astori and contactable by email at privacy@jakala.com.

7. Rights of the data subject

We inform you that, in relation to the aforementioned processing, you may exercise the rights provided for in Articles 15 et seq. of the Regulations. You, in particular, have the right to obtain:

  • a) Confirmation of the existence or otherwise of your personal data, even if not yet registered, and their communication in intelligible form and/or access to them;
  • b) A copy of the personal data;
  • c) The rectification of any of your personal data that may be inaccurate;
  • d) The deletion of your personal data;
  • e) The restriction of the processing of your personal data;
  • f) In a structured, commonly used and machine-readable format the personal data that you have provided to us or that you have created and to transmit them, directly or through the Controller, where technically possible, to another data controller (so-called right to data portability);
  • g) A certification that the operations relating to the rectification, erasure and limitation of data have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except where this proves impossible or involves a manifestly disproportionate use of means in relation to the right protected.
  • h) You also have the right to object, in whole or in part:
  • i) For legitimate reasons, to the processing of personal data concerning you, even if relevant to the purpose of collection;
  • l) To the processing of personal data concerning you for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

8. Retention and storage of personal data

Your personal data will be processed:

  • a) For the purposes set forth in (a) of the paragraph Purposes and legal basis of the processing for the duration of your employment relationship with Jakala; without prejudice, in any case, to the request for updating the information, which must be carried out at least annually;
  • b) For the purposes set forth in (b) of the paragraph Purpose and legal basis for processing for a period of 12 months from the time consent was given;
  • c) For the purposes set forth in (c) of the paragraph Purpose and legal basis for processing for a period of 12 months from the time consent was given;
  • d) For the purposes set forth in (d); (e) of the paragraph Purpose and legal basis of processing for the duration of your employment relationship with Jakala;

In the aforementioned cases, the data subject;s right to object to the processing at any time remains unaffected.

9. Complaints

Lastly, we inform you that if you believe that your rights have been violated you have the right to submit a complaint with the Data Protection Authority and/or other competent supervisory authority under the Regulations.

This Privacy Policy may be subject to change. If changes and/or updates are made, Jakala S.p.A. Societ; Benefit will post the new policy on the Platform. By continuing to access you agree to be bound by that new version of the Privacy Policy.
